Refund Policy
Limitlessassessments.com does not offer refunds for assessments purchased, membership plan fees or custom applications. An account credit to be used toward assessment purchases or plan fees may be issued at the sole discretion of Limitlessassessments.com in the event that the wrong type of assessment was purchased or there is a system error requiring retaking an assessment.
 
Use in Hiring
When using the Limitlessassessments.com System for hiring, it should be used as only one of the factors in your company's overall employment hiring process. The results from Limitlessassessments.com assessments should not be used as the sole determination whether to hire or not to hire an individual. The System is designed to assist in identifying job related preferences and abilities that should be more thoroughly investigated by interviews, work experience, background and reference checks. Limitlessassessments.com assessments do not measure violent tendencies, psychotic conditions, sexual deviance or political opinions and cannot be used in identifying these conditions or to predict any associated behaviors.

Governing Law and Dispute Resolution
These Terms of Use and any disputes arising from your use of the Limitlessassessments.com System are governed by the internal substantive laws of the State of Arizona, without respect to its conflict of laws principles. Jurisdiction for any claims arising under this agreement shall lie exclusively with the state or federal courts within Arizona. All disputes between the parties shall be submitted for arbitration before one arbitrator selected according to the American Arbitration Association. The parties agree to venue and jurisdiction in Arizona. 
 
Intellectual Property
The Limitlessassessments.com System, the Limitlessassessments.com Materials and all right, title and interest in and to the Limitlessassessments.com System and Limitlessassessments.com Materials are the sole property of Limitlessassessments.com or its licensors, and are protected by United States and foreign copyright, trademark and other laws. Unauthorized use of, copying, reverse engineering, decompiling, and creating derivative works based on any Limitlessassessments.com Proprietary Information is expressly forbidden except as otherwise permitted in writing by Limitlessassessments.com. You may be held legally responsible for any direct or indirect violation or infringement of Limitlessassessments.com' ownership rights in the Limitlessassessments.com Proprietary Information.  
 
Indemnification
You agree to defend, indemnify, and hold harmless  Limitlessassessments.com (and its subsidiaries, affiliates, officers, directors, shareholders, employees and agents) from and against any third party claims, actions or demands (including, without limitation, costs, damages and reasonable legal and accounting fees) alleging or resulting from or in connection with your use of the  LIMITLESSASSESSMENTS.COM System, assessments, LOST PROFITS, OR DAMAGES RESULTING FROM LOST DATA, LOST EMPLOYMENT OPPORTUNITY, OR BUSINESS INTERRUPTION, your use of the Services or your breach of this Agreement.  LIMITLESSASSESSMENTS.COM shall use reasonable efforts to provide you prompt notice of any such claim, suit, or proceeding.

IN NO EVENT WILL ABSOLUTE ARTISTRY INC. BE LIABLE FOR ANY DAMAGES OF ANY KIND INCLUDING WITHOUT LIMITATION ANY SPECIAL, INDIRECT, INCIDENTAL OR CONSEQUENTIAL DAMAGES EVEN IF ABSOLUTE ARTISTRY INC. HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.  ABSOLUTE ARTISTRY INC.
